Terms of use

These terms apply when you use games, apps or content published by Photon Technology International LLC. By installing or playing, you agree to them. If you do not agree, do not use our games.

Licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and play our games on devices you own or control, for your own non-commercial entertainment. Where you obtained the game through the App Store or Google Play, that store's own terms also apply and take precedence over these terms in the event of a conflict.

What you may not do

• Reverse engineer, decompile or attempt to extract the source code or assets, except where that restriction is prohibited by law.
• Modify the game, use cheats, bots or automation, or exploit bugs to gain an advantage or to disrupt other players.
• Redistribute, resell, sublicense or repackage the game or its assets.
• Use the game for anything unlawful.

Video, streaming and creator content

You may record, stream and monetise footage of our games on any platform, including YouTube and Twitch, without a separate licence and without owing us a revenue share. You may not present the game as your own work, redistribute the game itself, or use our name or logos in a way that implies we endorse or sponsor your channel.

Virtual items

Coins, vehicles, skins, upgrades and other in-game items are a limited licence to use them inside the game. They have no monetary value, cannot be exchanged for money or transferred outside the game, and may be changed or removed as the game is updated.

Advertising

Our games are free and supported by advertising, including optional rewarded video. Advertising content is supplied by third parties and we do not endorse it.

Availability

We may update, change or discontinue a game or any of its features at any time. We are not obliged to keep any particular title, feature or server available.

Intellectual property

The games, their names, logos, artwork, audio and code are owned by Photon Technology International LLC or its licensors and are protected by copyright and trade mark law. Nothing in these terms transfers ownership to you.

Disclaimer and liability

Our games are provided "as is" and "as available", without warranties of any kind to the fullest extent permitted by law. To the extent permitted by law, we are not liable for indirect, incidental or consequential losses, and our total liability to you for any claim relating to a game is limited to the amount you paid us for it, which for our free titles is zero. Nothing here limits liability that cannot be limited by law, including for death or personal injury caused by negligence.

Termination

This licence ends automatically if you breach these terms. You may end it at any time by uninstalling the game.

Governing law

These terms are governed by the laws of the state in which Photon Technology International LLC is registered, without regard to conflict of law rules. Nothing in this clause removes any protection you have under the mandatory consumer law of your country of residence.
